How To Get A Divorce If You Cannot Locate Your Spouse

Getting divorced is not a fast or easy process, but it can take even longer when you want a divorce but cannot find your spouse. This is not something that happens all the time, but there are situations when one spouse cannot find the other one, which creates extra work when trying to get a divorce. If this is the situation you are facing, here are several things you should know as you try to get divorced.

Look everywhere possible

The first thing you should do is look for your spouse. If you know their family members and close friends, call them and ask. You could also look at social media sites to find information. By digging in like this, you might be able to locate your spouse and even find out what the address is of where they are currently living. If you can do this, you would be able to send divorce papers to them.

Contact a divorce lawyer

Whether you find them or not, you should seek help from a lawyer for your divorce. Your lawyer will be able to give you more information about how to proceed, and they may even have different strategies you could use to try to find your spouse. In either case, you will need to seek help from a lawyer to file divorce papers.

Go through the process of publication

If you still cannot locate your spouse after filing the divorce papers, you can ask the court for something called an Order of Notice by Publication. This order grants you permission to advertise in local papers to find your spouse. You will have to run advertisements stating that you are seeking a divorce and you must list your names. If your spouse sees this, it will give them to respond to it. If not, you at least did your part in it.

Ask the court for a motion to dissolve the marriage

Finally, you can petition the court to dissolve your marriage, even if you still have not heard from your spouse. There is a waiting period for this, but you can eventually get a divorce through the court without your spouse's consent.
