Proving Your Fall in the Supermarket Was Due to Store Negligence

If you were grocery shopping and fell due to a spill on the floor caused by faulty equipment, you may wish to fight the business for monetary compensation to help pay for loss of wages if you cannot work and pay your medical bills. A slip and fall accident needs to be proven in a court of law before you will receive any type of payment. Here are some tips to use to help prove you were not at fault for your falling incident.

Follow Doctor's Orders Closely

Your actions following a slip and fall injury will most likely be scrutinized by the business' lawyers and perhaps even private investigators. They want to prove you were not hurt as you claim, making it important to go to a doctor regularly for monitoring of your condition. They will be able to write documentation proving you are indeed suffering from your injury. Make sure to fill any prescriptions on time as well. Do not partake in activities that are deemed unsafe for someone with your type of injury, as you do not know if someone is watching your actions.

Retain Witnesses for Testimony

If there were other people inside the grocery store who had witnessed your fall, they may have seen the condition of the flooring in the area where the incident had happened. If you had taken photographs of the spot immediately after you had fallen, you may have some customers in the background. Enlarge the photographs to see if you recognize any of the faces in them. Ask your friends and family as well, as someone may be able to get you in touch with them to write you a statement.

You can also post on social media in a neighborhood group or on your personal page asking if anyone was in the store on the date of your injury. If you know any of the employees of the store personally, ask them if they would be willing to testify that the floor was in a negligent condition when you had walked through the area.

Get Copies of Important Clues

In many cases it is difficult to prove that a person couldn't avoid falling due to a spill. If the liquid on the floor however was due to an equipment malfunction, it is the responsibility of the store owner to have the machinery serviced so patrons do not become injured. Have your attorney request any paperwork from the store after the fall proving they had a repair service come in to tend to the machinery in an attempt to cover up the reasoning for the fall. If they have a maintenance department in the store, have your lawyer request copies of their records to see if someone tended to the machine on a date after the incident.
